Allen County Updates
06/22/2021- Fort Wayne City Council votes
One of the greatest take-a ways from this meeting included the fact that the City Council attorney, Joe Bonahoom, verified that the City Council and County Commissioners were NOT prohibited from from creating an ordinance providing the immune passport purge! Home rule does in fact apply. Because the state legislature did not address private businesses, local authorities, such as City Council and County Commissioners may exercise their power to protect the citizens. The one caveat to the rule is that Mr. Bonahoom believes that the Department of Health has jurisdiction over these matters.
The question is: Do we want officials whom have not been elected, and are free of public accountability, ruling over personal liberties? Could that be the reason the Indiana State Legislature gave the County Commissioners the power to review and overturn rulings of the Health Department through SB5?

06/08/2021- Jason Arp, Introduces Resolution Against Vaccine Passports.
City Councilman Jason Arp will introduce a resolution that will make a statement against vaccine passports in the City of Fort Wayne. While we generally agree with the sentiments of the resolution there is still much to be done before Fort Wayne can celebrate.
First of all, if the resolution passes it is simply an official statement by the City Council and does NOT provide legal protections to the citizens and patrons of Fort Wayne. In order for the Council to take a true stand they would be required to file and vote "YES" to a similar ORDINANCE. Hoosiers for Medical Liberty appreciates the attempt but, hopes that this is only a precursor to an ordinance.
In talking with Jason it seems as though the City Council and potentially the County Commissioners feel it is NOT within their power to execute such an ordinance to protect the constitutional rights of Fort Wayne or Allen County Residents. Jason Arp has told us directly that he will clarify the issue with the council's attorney. We look forward to this clarification. In our own investigation, we see that there may be the potential for such an ordinance put forth by EITHER the City Council or County Commissioners because the Indiana State Legislature failed to provide governance regarding vaccine passports outside of government entities. The lack of governance of the issue creates a loophole for those servicing the public domain to discriminate against those whom elect not to take a vaccination. This cannot be accepted.
Secondly, we noticed an area we would like to see improved upon. The resolution, as it is written, provides loopholes for some. Specifically on line 32 of the resolution a statement begins "except in certain healthcare related activities and other exceptional circumstances..." Our fear is that this vague description leaves it open for interpretation, especially if this were to be translated into a ordinance.
