We need you to take action ASAP. 

You are AMAZING! Your calls had the senate in a tizzy.

I was watching session and the tension was palpable. After they completed the 2nd reading list you could see the panic and difficulty in deciding what was going to happen even though they had already caucused TWICE during session today.

There were multiple people moving in and out of the chamber, talking back and forth in the hallway to confirm the plan.

Rod Bray, Senate Pro Temp and Republican Leader motioned to move the entire 3rd reading calendar to tomorrow! This is particularly interesting after his recent comments. See our FB post here.

They were scrambling and refused to hear HB1001 because of the pressure from H4ML activists!

Wednesday March 1st is the last day that it can be heard before dying.


It is a bad bill, we want it dead!

HB1001: senate 3rd reading 2/28

Today at 1:30pm the senate will hear HB1001 on 3rd reading.

What that means is that they will hear the title, a short synopsis from the sponsor and vote on final passage of the bill.  However, it isn't quite over. 

When legislation is passed in one chamber and then changed in another the author can "concur" or "dissent" the changes. If the author concurs it moves on for the Governors signature or veto. However, it if the author dissents then the bill goes to conference committee, which is referred to as the "wild west." Pretty much anything can happen in this committee.

At this point we have no hope that the bill will provide even a shred of Medical Liberty. At this point it is discrimination and tyranny. You can read more about that in the last blog. It covers the bill quite nicely and explains the changes that have happened.

Ultimately, the bill offers no greater protection than what current federal regulations do. However it does codify testing twice weekly.
This simple act will undoubtedly ensure that no Hoosier will be able to find an attorney to take discrimination cases based on testing of the unvaccinated in the work place.
As the law stands now, finding an attorney to take on a case for masking or testing is incredibly difficult. However once this bill passes it will me impossible.

I know that the legislators and lobbyists can twist and mince words to make you feel as though you are "getting something."

Let me assure you, you are "getting something," but in this case- nothing would be a lot better.

HB1001 passes senate 2nd reading

This is going to be a quick update. I am going to try to briefly update you on the status of amendments to HB1001. I may pop back on here after I make dinner to add more depth to the update. 

HB1001- COVID-19 vaccinations.
  • A discriminatory policy that ensures employers can treat employees differently based on a Medical or religious exemption. (Negative)
  • Employers may require 2/weekly testing. (Negative)
  • Allows "tradsies" where employees can agree to testing rather than vaccination (Negative)
  • Allows recognition of natural immunity, proof required every 3 months and still subject to 2/weekly testing. (Negative)
  • Excludes a long list of employees including those working in/for: (Negative)
    • Other states
    • Companies with federal contracts, subcontracts, or grants.
    • Health care facilities
    • Professional sports organizations
    • Entertainment complexes
    • In close proximity to the live sports or entertainment (Read that again, but slower.)
    • Organization or venue engaged in producing or presenting musical, theatrical, or other types of cultural entertainment
    • The United States and its agencies & instrumentalities... Does that include?
      • Public School Systems
      • Any of the following: Ball State University, Indiana State University. Indiana University, Ivy Tech Community College, Purdue University, University of Southern Indiana, Vincennes University
      • Political Subdivisions/Municipalities (City/town jobs)
Amendment:
  • Adds administrative authority (Negative)
  • Adds standing orders for 5 and up (Neutral)
  • Adds protection of unemployment (Neutral/Positive) True medical liberty would ensure Hoosiers wouldn't be fired for asserting their bodily autonomy.
  • Added Organization or venue engaged in producing or presenting musical, theatrical, or other types of cultural entertainment to the list of people who won't get "protection" (Negative)
  • Removed "Indiana Governmental Entity" from list of employees not protected, but added in "United States and its agencies & instrumentalities" in which entities like schools, libraries etc may be considered. (This portion might be a "net zero")
  • Removes "tradsies" exemption option. Testing in leiu of vaccination for those who don't have medical or religious objections. (Neutral/Negative)
  • An employer may not require a test for the presence of COVID-19 unless the test:
    1. has been approved by the federal Food and Drug Administration;
    2. is the least invasive testing option available; and
    3. does not create an undue burden on the employee to receive the test. (Neutral/Negative)

I would like to note: one of the authors biggest talking points for the administrative authority portion was "all the other states are accepting federal funding and Indiana would be "missing out." However today in testimony Senator Melton mentioned that only 27 other states are accepting SNAP funding. Sounds like plenty of states refuse to contribute to poor federal fiscal choices.

So what you are left with is a pile of gobbly gook that promotes poor federal fiscal choices, opens the door for Federal meddling, kind of recognizes natural immunity, and codifies discrimination through testing.

HB1001 is a threat to your Medical Liberty!

This bill and its amendment were passed today without the objection of a SINGLE Senator. They should be ashamed of themselves.

HB1001 will likely wind up on the schedule for Monday and be heard on 3rd readings. There are no options for amendments.

Hoosiers deserve to know how their elected officials are voting. This is exactly what we are asking for in our latest call to action.

Call your senator and tell them:

"HB1001 is discriminatory and a threat to Medial Liberty. Hoosiers deserve a roll call and a NO vote on HB1001. I expect you to ask for a roll call vote. If the bill passes and no roll call is taken we must assume that you voted in favor and will be holding you accountable."

HB1001: adding bad language back

Can you believe the nerve?

You all have spoken out against the "Administrative Authority" of HB1001 & SB3 and yet it seems that your elected officials are going to pass it at any cost.

Just to recap, the administrative authority portion of the bill would give the Secretary of Family & Social Services (un-elected official) the power to accept any federal policy, recommendation or law connected to Federal Medicaid funding. The Secretary can also waive any portion of the title (Family & Human Services) to accept federal funding. It has similar provisions for SNAP funding.

This is an egregious and dangerous delegation of power. Hoosiers cannot hold anyone accountable for federal overreach through this capacity, and your weak legislature couldn't be more excited by that prospect.  When things go sideways and federal overreach rears its ugly head again, elected officials will be able to shrug their shoulders and say "It wasn't me. I can't control what the Secretary does."

You can go back and read some of the other blogs starting in November to watch the evolution of HB1001. I have also made "HB1001" a category so you can find all the posts easily. 

Ultimately, Rep Nisly & Jacob terrified House Republicans with their Liberty amendments on SB3 so they KILLED IT.

The House and Senate Republicans conspired together to add SB3's administrative authority language BACK into HB1001 to protect House Republicans from another BAD vote on Medical Liberty.

The irony of this is all to much. When HB1001 came to the senate they removed the administrative authority portion of the bill last week, Feb. 18th! But because they knew Rep Nisly and Jacob would force the house to go on record against Medical Liberty they killed SB3 and have no choice but to do an about face and add the language back in to HB1001.

The truth is we don't have a Medical Liberty Champion in the Senate. None of the Senators are willing to go out on that limb and defy the demands of Republican leadership, so they know they can get away with this... for now.


The feedback I am getting from our followers is quite damning.. Many people messaging back are feeling as though working with the current legislature is futile. They are TIRED of their words falling on deaf ears and ready for a change of representation.
Hoosiers for Medical Liberty does not endorse, support or oppose any candidate. We are a 501c4 social welfare organization. We simply EDUCATE the people on what their elected officials are doing at the state house.

Since the inception of HB1001 in November, Hoosiers have spoken out against this language, yet your elected officials are HELL BENT on passing this language to appease Gov. Holcomb.

HB1001: The saga continues

**Update 2/23/2022**
The senate has an amendment up tomorrow ADDING back in the administrative authority to "end" the State of Emergency. We must take action and call. They need to know that we are watching and will not tolerate this.
The ONLY reason they did this is because of the pressure you all placed on the House of Representatives to pass Rep Nisly's amendment. SB3 will probably die in the House and the Republican Caucus must work to build SB3 back in somewhere.

For clarity, the "un-elected official" is the Secretary of Family & Social Services.

Are you tired of hearing about HB1001?

I am tired of writing about it. Its been a long 4 months, and this bill has never provided Hoosiers with Medical Liberty.

At this point it is a serious threat to your Medical Liberty.

Let's take a look.

Initially, when you read the digest it seems like its ok. Hoosiers are able to use exemptions in the case of medical contraindications, religious reasons, or prior infection with immunity. Hoosiers can also "choose" to get tested rather than take the vaccine.

How is this Medical Tyranny...?

Bill digests are DECEIVING. So you need to read the whole bill.

Sometimes legalese is just difficult to read, especially when you have a million things on your "to-do" list.

Let me break it down for you.

The first several sections change wording around in the "passport ban" from last year. The changes define "Indiana governmental entity." As a re-cap this so called "passport ban" just says that a "Local or state unit" (the state government) can't issue or require a vaccine passport.

It's kind of a joke, it really  didn't change anything to begin with. If you recall, there was a big case against IU for requiring vaccination of students. This went to the AG, Todd Rokita, and the school was allowed to continue requiring the students disclose vaccination status and face discriminatory testing.

FOOLERY.

Pay close attention to the definition of "Indiana governmental entity." We will be discussing it later. The definition includes a state educational institution (Ball State University, Indiana State University. Indiana University, Ivy Tech Community College, Purdue University, University of Southern Indiana, Vincennes University), political subdivision (municipalities), and a public school corporation. Also notice IU is in there- do you think this means that if it passes they won't be able to ask for vaccine status anymore?

Section 5 starts half way down page 3 of the document. It is reviews exemptions from Covid-19 requirements.

It quickly starts in with employees who the "protections" do not apply to, including those working in/for:
  1. Other states
  2. Companies with federal contracts, subcontracts, or grants.
  3. Health care facilities
  4. Professional sports organizations
  5. Entertainment complexes
  6. In close proximity to the live sports or entertainment
(there is an amendment by Senator Messmer to add: organization or venue engaged in producing or presenting musical, theatrical, or other types of cultural entertainment)

Those listed above are still entitled to protections from Title VII and the ADA.

Ok. Let's get this straight... As long as you don't work in one of the above and are an employee, paid or unpaid, including an independent contractor, subcontractor, or student trainee/intern you MAY continue on....
WAIT!
Remember how I pointed out the definition of "Indiana Governmental Entity" above- yep if you fall into an employee for one of those agencies- THE "PROTECTIONS" DO NOT APPLY TO YOU.


Ok so that list again...

The "protections" listed below do not apply to you if you work in/for
  1. Other states
  2. Companies with federal contracts, subcontracts, or grants.
  3. Health care facilities
  4. Professional sports organizations
  5. Entertainment complexes
  6. In close proximity to the live sports or entertainment (Read that again, but slower.)
  7. Public School Systems
  8. Any of the following: Ball State University, Indiana State University. Indiana University, Ivy Tech Community College, Purdue University, University of Southern Indiana, Vincennes University
  9. Political Subdivisions/Municipalities (City/town jobs)
  10. Federal employees
  11. Possibly** organization or venue engaged in producing or presenting musical, theatrical, or other types of cultural entertainment

Whew... so Who is left?

Any nerds out there want to figure out the percentage of Hoosiers that eliminates from these so called protections?

We are now 1/2 way down page 4 where we start to learn about exemptions.
  1. Medical- signed MD statement of contraindication- No further inquiry.
  2. Religious- Statement of sincerely held religious beliefs.
  3. Tradies- no vaccine as long as you test. (Though, Senator Messmer is trying to remove this in his amendment.)
  4. Natural immunity- Not so fast you may have to prove it every 3 months.

So the people who actually qualify for these "additional protections" can play "tradsies" for now, use a medical exemption with no further inquiry, use a religious exemption (no change), and claim natural immunity as long as you can prove it every 3 months. 

WOW! These legislators went out of their way to really "protect you." Didn't they! So generous.

OH WAIT.

They also included that an employer may require testing up to twice a week regardless of the exemption used. THIS IS DISCRIMINATION!

The Indiana State Legislature wants to make DISCRIMINATION INTO LAW!?!

The Senate also removed the portion requiring the employer to pay for testing and your ability to file for unemployment if you are terminated for failing to get vaccinated.
They not only missed the mark, I think they may have shot themselves in the foot with this one.
The bad news doesn't stop there.

Do you remember when HB1001 had portions that allowed federal strings into our state?  We rallied hard against that and they took it out.

These legislators are tricky, they weren't about to let their deal with Governor Holcomb die. The Senate never had any intention of passing Medical Liberty, and so they put the "administrative authorities" in SB3 and it passed out of the Senate and is now waiting to be heard in the House. This bill is one of the utmost priorities for the legislature.

The first couple bills on either side are usually guaranteed to pass. So SB1, SB2, SB3 or HB1001, HB1002, HB1003. As you can see its no mistake that they had this language starting in both sides, they need to make sure it goes through. I personally would love to see SB3 die, but the reality is that it probably won't.

So if they are going to pass this we want to at least try to force them to "Follow the science."

Rep. Curt Nisly has drafted an amendment that would fill the requests of our petition for an Injury Investigation. The "FOLLOW THE SCIENCE" amendment would ensure that there is an INDEPENDENT 3rd party review of all VAERS reports filed by or on behalf of an Indiana resident. It will also ensure that providers and patients are educated on VAERS, and the federal injury compensation programs.

Urging your State House Representative to "Vote YES on the FOLLOW THE SCIENCE Amendment, or vote NO on SB3" will be part of our call to action below.

Bear in mind, we know SB3 is garbage. We do not want this bill passed. The short of this bill: Allows an unelected official to apply a waiver to the section of code and or accept any federal law, regulation, guidance or policy related to COVID-19 in order to get federal funding for Medicad. Representative John Jacob has quite a few amendments to fix this as well.

It also allows the age of standing orders for vaccinations to be lowered to 5 from 11. There is a lot of confusion about this. The standing order does NOT mean a mandate, or that they can do it without parental consent. It simply means that the doctor does not have to write a prescription and parents can take their children to a pharmacy to get the shot. While I think that these vaccines should be given by providers who know the child, this is NOT a threat to medical Liberty.

I have been putting in O.T. trying to find a legislator brave enough to fight against those destroying Medical Liberty, but I am empty handed. HB1001 will be heard in the Senate Health & Provider Services Tomorrow Wednesday February 16th.
 
I am completely shocked. Now is not the time to drop our guard. We must remember that settling for a rehash of Federal Law is NOT enough to protect Hoosiers. In fact, HB1001 still has a plethora of flaws.
 
We must make it clear that Hoosiers deserve better. Here is a list of concerns with the bill the way it is:
  • Employers can still mandate and coerce employees into vaccination.
  • HB1001 excludes “Indiana governmental entity” meaning state employees, including state colleges and public schools, do not get protections. (Pg 10 line 30)
  • HB1001 doesn’t protect federal contractors, even though it wouldn’t prevent a mandate, just allows employees exemptions. (Pg 9 line 18)
  • Employers don’t have to comply with this law if they provide accommodations through Federal Regulations. If they use this as an excuse can they still inquire further after initial exemption? (Pg 9 line 18)
  • HB1001 codifies discrimination through testing. (Pg 11 line 4)
  • Hoosier Tax dollars will be used to fund mandated testing through the department of workforce development. (Pg 11, line 18)
  • Natural immunity is only recognized for 6 months despite science stating much longer (Pg 12 line 27)
  • HB 1001 is not enforceable. There is no penalty for breaking this law. What is the point?
  • Injuries are largely ignored and dismissed.
  • Indiana has had over 25,000 VAERS reports and they have gone uninvestigated.
  • Hoosiers who have faced vaccine injury after a mandate are left without support and have not received workman's compensation.
  • Informed consent is not occurring.
  • Largely providers are unaware of what VAERS is or how to make a report.
  • Hoosiers deserve Medical Liberty.

“Hoosiers want an end to mandates and language that looks more like Senator Kruse’s is SB 286! If you refuse to do anything more than repeat federal regulations this bill must include language for:
  1. An immediate independent 3rd party investigation for all Hoosier VAERS reports.
  2. Required education of all working in health care on VAERS reporting & CICP
  3. Required education on adverse events, VAERS reporting, and CICP for patients prior to vaccination. “

HB1001 is getting a hearing in the Senate tomorrow! Read the blog to see the laundry list of flaws with the bill and an important call to action!

Dying bills. 

All TRUE Medical Liberty bills died in committee. It appears that leadership has no intention of providing your Medical Liberty.

HB1003

The legislature is attempted to “fix” the decades-long nursing shortage. In their haste & refusal to listen to nurses, HB1003 will decrease safety of patients & staff alike. 
As I mentioned above, legislative session is half over and the bills have moved from one chamber to the other.  We have a couple bills in the house we are watching and there isn't a whole lot happening in the Senate other than what is listed above.

Once all the bills are heard the end of session will conclude with “Conference Committee.” During this time, bills that were changed by the other chamber will be heard and decided upon.

We will be watching what happens there. Historically legislators pull out their greatest trickery passing things that get stripped out in general legislative process.

We know that it is very unlikely that anything will move through in regular session for Medical Liberty, but we aren't ready to give up, knowing anything is possible in conference committee.

We just launched a new petition and hope to pressure the legislature to take action. Check it out below.

Injury Investigation

Did you get a chance to read Margaret Menge's article from The Center Square? Last month she broke the story of a 40% increase in deaths among 18-64 year olds in Indiana and since it has been featured on national news.

Check out the story here. As it turns out One America, an insurance company, said that these were “unheard of” numbers and it wasn't isolated to Indiana.

Ultimately there is a lot of speculation as to why this age group in seeing such a significant rise in deaths.  Some speculate that it is, at least in part, related to the COVID vaccination.

Indiana has also seen it's fair share of suspected adverse events with over 25,000 VAERS reports in Indiana alone.

It is time for our leadership and medical community to investigate the issue.

Calls to action & Text messages.

This year was a bit strange, legislative session has been moving super fast and I feel like I don't know where it went.

We have also had tremendous growth, but in that I have noticed that some of you want every single text message (thank you) and others are not quite able to keep up with all texts but want to remain involved. 

In order to find a happy middle ground we have created a group for everyone.  I am not sure if we will use this much this year but wanted to roll it out before we really need it.

As you can see from the graphic to the side all you have to do is text the name of the group you would like to join to us. After that we will keep you updated from there.

H4ML Near Me

I have been dreaming of this for quite some time, and it is finally here.

In addition to our zoom meeting, Fort Wayne Locals will be able to sit in on the meeting with their neighbors at Crossroads Wellness Center.
