SB96 – A SNEAK ATTACK ON OUR KIDS.

You may have noticed that SB96 didn’t get heard last week… but don’t breathe easy yet. It’s back on the schedule for Tuesday at 8:30 AM.

Here’s what you need to know:

SB96 seems harmless. It claims to align pharmacist vaccination rules with ACIP/CDC guidelines without requiring an additional vote from our legislators. 

But the REAL goal is to eliminate age limits for vaccines given in pharmacies.

💉 They’re paving the way for kid vaccine drive-thrus.
Insiders tell us this bill was declared “dead” because of public pressure and “controversy.” 

But don’t be fooled--
💬 “Dead” bills sometimes turn into zombies.
🧾 The language can still be reused, especially in conference committee.

The Indiana Immunization Coalition has been "educating" retail pharmacies that they will start giving catch up vaccines since 2023. 

Including that there is no maximum number of vaccinces at one time including, "If a kid needs 11 vaccines, you give all 11."

They’re getting antsy and expected kids vaccine drive-thrus to be passed last year- but you stopped them!

And we can do it again, but we must make our opinions known.

Last week, HB1003 was heard in committee. Hoosiers for Medical Liberty founder Ashley Grogg testified, urging legislators to take real action to protect your medical records.
Ashley demanded:
🔒 Opt-in consent for all health information exchanges (HIEs)
📢 Notification for anyone already impacted
✏️ Access and correction rights for those who choose to participate

Rather than applaud her for standing up for Hoosiers, committee members dismissed our concerns. One legislator even claimed medical privacy was “out of scope” because H4ML primarily advocates for vaccine choice.

Let’s be clear:
Privacy is never out of scope. It is the foundation of informed decision-making.

Only Senator Tyler Johnson had the courage to raise an intelligent concern: federal preemption.

Here’s what he — and the rest of the committee — need to know:

✅ HIPAA sets a floor, not a ceiling. States can implement stricter protections like opt-in consent for HIEs.
✅ Many states — including New York, Minnesota, and California — already do.
✅ There is no federal law that prohibits Indiana from requiring stronger privacy protections.
This bill will be heard again Wednesday at 9:00 AM. Let’s make our voices heard.

We’ve been fighting to get real protections added to HB1003—and we’re not giving up.

Now, the Senate Health & Provider Services Committee will be hearing the bill, and we must make our voices heard.

The current version of HB1003 still allows your personal health records to be accessed and shared without your consent—and even worse, it protects the status quo where Hoosiers' medical data is being sold and used without their knowledge.

Despite minor concessions, HB1003 still fails to address the core issue: Hoosiers' personal health records can be accessed and shared without their knowledge or consent.

The bill does nothing to stop the Indiana Health Information Exchange (IHIE) from continuing to operate, allowing the release of sensitive medical records without patient authorization.

The bill still lacks clear opt-in requirements, notification for those already affected, transparency about who has accessed records, and enforceable penalties for violations. Without these critical protections, the privacy of Hoosiers remains vulnerable.

Hurry up and wait.  I feel like I have been transported back to the days of working in the hospital. No real progress, just waiting for the wheels of the machine to turn.
 
I sat in on the House Public Health Committee today, it lasted about 2 hours before being truncated prior to hearing SB96.
 
There were three bills to be heard, and the second bill (SB473) was not even completed.

Constituents for that bill were denied the opportunity to speak, despite lobbyists being allowed to present their amendments. Those advocating for the citizens were not privy to the contents of the amendments before testimony. I’ll have more on this later… IT HAS ME HOT!
 
SB96- as a recap it is a pretty worthless bill to lobbyists as it stands.

The summary ensures the legislature doesn’t have to vote to add a new vaccine that has been approved by ACIP/CDC to be added to the list of vaccines that pharmacists can administer under a standing order.

The TRUE purpose of this bill is to establish an entry point for eliminating the minimum age requirement for pharmacy-administered vaccinations.

But…

Inside sources tell me, this bill died a few days ago. I was told it died because of “controversy.”

If this bill comes back to committee, it will likely just be for testimony before being tabled. The language will remain “in play” and can be snuck in somewhere else.

This is the second year for this legislation and we know that the special interest group, Indiana Immunization Coalition, was educating retail pharmacies about these changes back in 2023! I am sure they are getting antsy.

If language for kids vaccine drive-thrus is going to be passed, I don’t think the legislature has the courage to do that in the light of day.

You might be wondering why I feel this way…

Let me share.

The legislature is constantly making back-door deals, bellying up to the feasts offered by lobbyists, and holding private “pre-committee” meetings where they discuss and DETERMINE what actions they will take during the public committee meeting.

In fact, today, my suspicions about amendments to SB96 were confirmed.

When I called out the fact that the amendments were not posted online before the committee meeting, I was essentially met with the sentiment that THE PUBLIC DOESN’T NEED TO KNOW.

Government MUST be transparent.

Hoosiers have the right to know which amendments are being considered and who is bringing them to the table. –Again, more on this at a later time…
 
Back to the issue at hand…
 
I am truly concerned that the legislature will continue to use underhanded tricks to get vaccine drive-thrus.

:I suspect the drive-thru language will be inserted in another bill when we least expect it- or worse, slapped in a random bill during conference committee.

💀🚨dangerous bill being mascaraed as "parental rights".

SB143- Anti-Parental rights bill's goal isn't to protect your fundamental parental rights, but to give you a way to sue the gov't AFTER your rights are violated.

Worse yet, the next time someone decides there is a compelling governmental interest, your parental rights can be trampled, in the "least restrictive means."

Like a mask? Vaccine? Quarantine?

I met with those pushing for this bill and was able to ask pointed questions.

They admitted that they did not take into account how this would impact vaccination rights.
They admitted that they did not have a case example of how this had helped a SINGLE family in other states.
They admitted in committee that language passed in other states had not lead to an increase in litigation.
They even admitted that this language had not had a "chilling effect" or changed the behavior of stat agencies who were committing the offenses this bill is designed to stop.

So HOW has this languages helped anyone?

Are you willing to risk your parental rights for "compelling governmental interests" for no benefit?

I am not.

SB143 was heard in the House Judiciary Committee and passed 10-3. Unfortunately this dangerous bill will move on to 2nd reading as early as Thursday.

At the close of the committee hearing Senator Liz Brown (Ft. Wayne) got up and stated "We know parents are the primary care givers."

Does Liz really think you are just your children's "caregiver"?

Brown and the other legislators need a clear message- PARENTAL RIGHTS ARE NOT SECONDARY to a compelling governmental interest.

Hoosiers want to PREVENT the violation of rights, not simply be able to litigate AFTER the fact.

Proponents of the bill tell use that this will reduce violations of parenental rights while in the same breath explain how current laws are being ignored.

Who in their right mind would believe that those who don't obey the law are going to suddenly start when a new one is instituted?

Their response might include statements about why the application of "strict scrutiny" is so important and how being able to sue the government will change these issues.

WRONG. The taxpayers will be paying the penalties for the actions of people who break the law, violate parental rights and are being paid salaries by--- THE TAX PAYERS.

Can someone please pinch me, wake me up from this nightmare- NONE OF THIS MAKES SENSE.

Schools cant find and keep good teachers.
DCS can't find and keep good social workers- and the ones they do have are over worked, under qualified, or underpaid.

Worst of all, rouge teachers/DCS employees are NOT going to care if your tax dollars are wasted on litigation so long as their agenda is being carried out.

Litigation is not going to fix this problem.

Adding insult to injury, this language tells the court system AND those violating parental rights HOW to explain how their actions were necessary as it relates to a compelling governmental interest.

Finally, today- legislators added salt to the wound by removing the requirement for the state to carry burden of proof that they did not violate the parental rights. Burden of proof will now rest squarely on the shoulders of the parents whose rights were violated.
