October 20, 2022- Advisory Committee on Immunization Practices (ACIP) unanimously passed the addition of COVID-19 vaccination to the childhood schedule.

What does this mean? 

This means that the CDC is recommending the COVID-19 vaccination for all children 6 months and older per the childhood immunization schedule. 

The CDC is the reigning authority on vaccination and childhood immunizations in the United States and the schedule they release is considered “standard of care.”

Typically, when the CDC makes changes to the schedule, states follow the recommendations and physician’s offices begin using the new “standard of care.” 


You may begin to see these vaccines offered at routine visits and even given at the same time as “routine” vaccinations without much notice by some providers. 

This does NOT mean it has been added to the vaccinations “required” for those who do not use a religious exemption in Indiana. More on this below. 

The addition to the childhood schedule permanently removes manufacturer liability for injuries incurred as the result of vaccination. All vaccinations on the childhood immunization schedule are exempt from liability. 

KNOW YOUR RIGHTS.  

Parents call the shots, and you deserve to know what is on that tray!  Just because a vaccine is recommended by the CDC or even “required” for school doesn’t mean that there is no other option. Indiana students have the right to a religious exemption. Read more on exemptions here.

Some parents accept some vaccinations and decline others. If your child receives any vaccinations, you should be getting informed consent BEFORE the vaccines are drawn up or administered.  

Most offices don’t do this.  

Informed consent consists of the vaccination name, illness it is to prevent, risks of the illness, risks of the vaccination, benefits of the vaccination, and alternatives to the vaccination.  

In addition to informed consent, you should be receiving the “Vaccine Information Statement” from the CDC PRIOR to the vaccination. This is a legal requirement.  

If your child is scheduled for a well visit, address which vaccinations your child is scheduled for as well as any concerns before the doctor or nurse leaves the room to get vaccines. Once the nurse returns, ask specifically for the syringes to be reviewed by name prior to administering. This second review gives you the opportunity to verify what your child is getting and that you consent to the vaccination.

You have the right to ask questions, delay, or decline any vaccination even if it is drawn up.  

Unfortunately, many Hoosiers are not aware that they have the right to decline any medical treatment or procedure. We need to help educate our friends and neighbors to seek out informed consent and a risk benefit analysis. Check out our resources here.

Tell parents to be mindful and ASK what vaccines are due before the nurse administers or even draws them up. Encourage them to discuss the risks and benefits of both natural infection and vaccination for their child for each vaccination.

Be informed on the issue.

Each state governs their own requirements for schools.  

During the ACIP meeting, participants of the meeting were quick to point out that ACIP and the CDC are not in control of the vaccination requirements for schools.

Those familiar with the process know that the state health officials and legislatures typically follow the advice of ACIP & the CDC.   

The requirement for school children has not been determined by Indiana. Local journalist Margaret Menge recently wrote that the Indiana Department of Health (IDOH) said they would not be making a requirement for Indiana Students in an email response.

While we appreciate that a response was sent to Ms. Menge, the state has not addressed this in an official capacity on their website or on social media. The state has not had a great track record protecting its citizens against mandatory covid vaccinations. Much like doctors’ offices it is typical to follow the “standard of care” set forth by the CDC.

It is important to let the health department know Hoosiers do not want this mandated for school children who haven’t claimed a religious exemption.
 
It is also important to note that in the event that the state does require the covid vaccine for school children, public school children have a right to religious exemption for all vaccines including Covid-19.

Indiana state code 20-34-4-2 requires vaccination of school children, who do not claim a religious exemption, to be vaccinated for diphtheria; pertussis (whooping cough); tetanus; measles; rubella; poliomyelitis; mumps; varicella; hepatitis A; hepatitis B; and meningitis.  

Indiana Code 20-34-3-2 provides religious exemptions for vaccinations. For a student to claim a religious exemption a parent or guardian must submit a written statement of religious objection. Nothing more is required by law.

In light of Medical information warranting a change in the name of public health the IDOH may expand or modify the list of required vaccinations for students who do not claim a religious exemption. Basically, when the CDC and ACIP change the schedule, so can the IDOH. If a spike of cases occurs, they could change the requirements. By law the IDOH is required to submit a 2 year calendar each year on November 30th. In the case of an emergency the deadline for reporting does not apply.

According to this law the requirements may be changed at any time. That means that even though the State Department of Health is not currently planning to require it for school children, it doesn’t mean that they can’t or won’t change their mind.

Acting quickly to work against the COVID-19 vaccination being added to the immunizations required for those who do not use a religious exemption is key! Hoosiers need to step up and help provide information for our unsuspecting neighbors and family members.

Conversations don’t have to be difficult.

Our call to action.

Make calls to the State Board of Health, State Legislators, and County Commissioners.   

You might be wondering why the county commissioners are included.  We have talked about the Governor’s Public Health Commission for the past several months and how the state is wanting to “centralize” or “regionalize” Indiana’s public health agencies. 

Is it a good idea to hand over power to the CDC?

Orders will be passed from the CDC to the state and the counties will be forced to comply. This issue alone deserves its own call to action, but with the pressing news about ACIP adding the COVID vaccine to the childhood schedule we are combining these.    

The Governor’s Public Health Commission met over the course of several months making recommendations with the goal to develop "regionalized, equitable, and sustainable public health.”

INFORM OTHERS

When we heard that ACIP would be voting we knew the Covid vaccine would be added to the childhood schedule.  

You might be wondering why we asked you to comment if we knew it was going to pass.  

The answer is simple, we are still accountable for our actions.

If at any point we sit by and let these things happen “to us,” we become VICTIMS.  

We are not victims.  

We know the risk, so we do things differently and we must fight for those who don’t know any different than to follow based on trust alone.  

At this point, one of the most important things for us to do is share this information with others.  We must give them the opportunity to have informed consent.

Implied consent?

Does your child’s mere presence at school imply your consent to have them vaccinated?

We have been seeing clips from the World Health Organization (WHO) on “implied consent” buzz around the internet like hornets on honey!

Unless you are living under a rock you have certainly heard about this, and maybe even panicked a little.

We have seen a lot of talk but very little action on the matter. We intend to fix that.  Scroll down for the call to action!

We can help you become the change maker in your area, but more on that later…
If you are in the vast majority of parents wanting to wait to vaccinate against COVID-19, you are probably overwhelmed with yet another obstacle facing the public school system and trying to figure out what to do next.

Are you planning to remove your children from school?

Do you have concerns that a school “pop-up clinic” might vaccinate your child without your knowledge?

We need to get to the bottom of this and FAST.

What is the truth?

The truth is…

The WHO did publish a pamphlet with the offensive language.

We have heard reports of schools historically attempting to vaccinate for the flu without written consent from parents.

Hold on! This should make you angry, but not scared.

We said that they “attempted” to vaccinate without consent from parents. The plans were foiled when concerned parents started to voice concerns and notify others.

YOUR VOICE MATTERS!

That should give you a new way to “channel” your anger.

After all, anger is only good when it motivates you to make positive change.
 
Change can only come from action. 

This is probably one of the greatest shortcomings in the medical liberty movement in Indiana. We have a lot of concerned citizens trying to help, yet they are missing the mark. Why?

Many are willing to fan the flames and create anger and even fear surrounding the loss of rights. Few provide instructions on how to help fix a problem. This is one area that Hoosiers for Medical Liberty is committed to.

The last thing we want is for you to be scared and feeling helpless. When you are scared your brain tends to disengage. When you feel helpless you aren't motivated to make change. We need to be cool, calm, collected, and motivated while battling for our rights.

Hoosiers for Medical Liberty is here to help you move out of the flight or fight mode and into a space where you can effectively make change…

But how?

We need to look at a few more truths before we get there. We know WHO did release guidance on implied consent. We know that schools have historically attempted to try deploying these techniques.
 
But we also know…

Indiana State Code 16-41-9-1.7 on Immunization Programs states
“No person may be required to receive an immunization without that person‘s consent. No child may be required to receive an immunization without the consent of the child’s parent, guardian, or custodian. The state department may implement the procedures in section 1.5* of this chapter concerning a person who refuses to receive an immunization or the child of a parent, guardian, or custodian who refuses to consent to the child receiving the immunization.”

While this code does not specifically state how consent is to be obtained it is a standard rule that consent for a vaccination or procedure should be written.

Any time you visit a doctor’s office, hospital, or clinic you are presented with written materials and asked to sign giving consent for treatment.

Your pediatrician should ask you to initial a form for each vaccination on the childhood schedule.

Deviating from this standard protocol would seem to open the door to lawsuits against clinics AND the clinicians providing the treatments.

Read that again, bypassing standard consent procedures may open the clinic and or clinician to lawsuits.  In health care, if it isn’t documented, it isn’t done. This is applied to providing consent as well.

Rights cannot be taken away, you must relinquish them.

The above mentioned does not mean we sit on our laurels and continue on without concern.

We must take action. The logical first step is to let the schools know that we are aware and will not stand for foolery.

Here is your call to action:

  3. Call your school board & corporation School Nurse and tell them:

We demand transparency around vaccination clinics. If clinics are planned for our school written informed consent must be utilized. We will not stand for any form of implied consent procedures. Further, if clinics must be in schools, we expect vaccination times to occur outside of school hours to avoid vaccination mix-ups and disruption of the learning environment.

Will the Indiana State legislature FIX THEIR FAILURE in September?

The Indiana State Legislature failed you when the passed a weak so-called "vaccine passport ban. Did they really think that you would believe that HB 1405 was really "the best they could do?"

The Indiana State House of Representatives had multiple opportunities to pass a true "immunity passport ban" to ensure you were blocked from entering grocery stores, restaurants, gyms, etc. They refused to protect your freedoms.
When you call, your legislators have been telling you they can't do anything until next year. What if they had the option?
An inside source contacted Hoosiers for Medical Liberty this week and notified us that the Indiana State Legislature WILL be back in Indy for a special session in September. Will they do the right thing and fix the gaps left by their crummy legislation, or have they been virtue signaling?

What is even more interesting is that this inside source discussed two "vehicle bills." Vehicle bills can be used for legitimately anything. If the Indiana State legislature truly cared about their constituents, they would use this opportunity to protect them from tyranny. This could be done by legislating protections as above AND ending the state of emergency as proposed by House Representatives Nisly & Jacob.

Hoosiers, you are PAYING your representatives to go back to the Statehouse. Don't you deserve protection? They need to live up to the title of REPRESENTATIVE! No longer can we allow employees to be fired, harassed, and belittled. We cannot allow our students to be intimidated by "authority figures."

This past week Purdue students were verbally abused while waiting outdoors for 3 hours in scorching heat for surveillance testing. Reports have come in stating this was just a couple days after undergoing testing to come on campus. These are punitive measures designed coerce students into being vaccinated. Horror stories have come in from students reporting staff members trotting the line making remarks such as, "Are you sure you don't want to step out of this line and get vaccinated right now?"

The State Legislature has the power to fix all of this!

We need your help!

Do you remember our TAKE ACTION campaign? It started in July and we have 550 Hoosiers calling our legislators. We heard back from activists stating that a couple of the Legislative Aids were no longer taking calls due to the influx.

I think we can do better, don't you? Do you think we can fill their phone lines and voicemail boxes? Can you help us reach 1,000 participants? We would appreciate you sharing this message.

Let's make a round of calls Friday 8/27 and then again on our first Tuesday of the month. As soon as we hear when they are in the statehouse, we will welcome them back to the endless sound of phones ringing!

SB47, INFORMED CONSENT, & H4ML NEAR ME

Hello Hoosiers!
It has been a little while since I posted, here is an update on all the recent happenings.
The digest version:
  1. Call your State Representative and tell them you “Expect a YES vote on Rep Jacob’s 2 amendments to SB47!” Then sign our Resist the Registry petition.
  2. Want to participate in an education event in Indy March 27th & 28th or April 3rd & 4th?
  3. Announcing H4ML near me! We are launching local meetings! Get more INFO or VOLUNTEER.
  4. Get the upper hand in politics. Attend one of the many classes here in Indiana taught by the Foundation for Applied Conservative Leadership.

Full Details!

🚨This is an urgent call to action 🚨
Please make sure that you are contacting your State House Representative about Rep. John Jacob’s amendments to SB47! We want them voted on asap.

There has been a lot of confusion surrounding SB47 and difficulty finding it so I wanted to be sure to clear that up. It has nothing to do with children providing consent for themselves. SB47 allows the administration of an immunization for coronavirus disease by a pharmacist and pharmacy technician under direct supervision. Pharmacists/Pharmacy techs can already provide several immunizations, this just adds coronavirus to that this. The bill isn’t harmful to medical liberty but it certainly could use some strengthening and that is exactly what Rep. John Jacob’s amendments do.

Rep Jacob has 2 different amendments fortifying Hoosier Medical Liberty! These amendments need to pass.
  1. Stopping the transfer of information from physicians to other agencies without the SIGNED consent of the individual. In more detail: it will prevent a physician or an employee of a physician, physician group, hospital, or other health care provider from disclosing an individual's eligibility for a vaccination or immunization; or add an individual's name to a vaccination or immunization registry or contact list that is administered by: a state agency, a federal agency, a pharmacy, a health clinic or a vaccination or immunization distribution site.
  2. Adding informed consent requirements to pharmacy administered vaccinations, including a clause regarding those under Emergency Use Authorization. Strengthening informed consent law for physicians and other providers including information for vaccination and Emergency Use Authorization.
It seems as though the other members of the House of Representatives do not want to vote on these amendments. The House Sponsor Rep. Davisson has “passed” on the bill 3 times since the filing of Rep. Jacob’s amendments. We have heard that he “does not support the amendments.” The proposed amendments are straight forward and clear cut. We have even heard that some members of the House have stated they are “common sense” and “better than the bill itself.” We need to make sure that we bring attention to the issue so that our Representatives are informed about this important issue.

Want the upper hand in politics? Time to take a Political Leadership class from the Foundation for Applied Conservative Leadership! The class is a day event including a light lunch. I will continue to sing the praises of this organization because it is what truly lit my fire, gave me hope, and the tools to be successful in political battles. These classes have been popping up around Indiana and you do not want to miss them.
There is a class once a month from April to June throughout the state. April 10th will be in New Albany, May 15th in Fort Wayne, and June 19th in Anderson. Get more info here. It is also my understanding that Merrillville will also be hosting a class. In addition to these, I would love to see classes scheduled in West Central Indiana and South West Indiana. Indiana vaccine exemptions

Today we will talk about vaccine exemptions!
This will be one of the most sought-after blog posts I ever write! Before we get to the details there are a few things you should know. Unfortunately, as you will see below these exemptions do NOT cover all Hoosiers nor do they provide adult protection against COVID-19 vaccine mandates. We sincerely hope that you will take a few moments and complete our petition HERE to protect Hoosiers should vaccines be mandated by employers. This is a very real issue and cannot wait any longer. The team here at Hoosiers for Medical Liberty is working diligently to protect your rights and we cannot do it without you so be sure to sign the petition and share it with your friends.
Once you have completed the petition you will be directed to a membership page where you can become a member for only $10 a year. This membership keeps you up to date on our work, educational events, activities, and funds everything we do! If you can afford more than $10 please consider donating more. We have tried to make membership affordable to all Hoosiers. However, as we continue to work, our costs will surpass the funds we collect through basic membership. AS PROMISED: VACCINE EXEMPTIONS!
I was once in your position. Frantically searching to find out how I would be able to work without getting the flu shot or send my kids to daycare or to school without all of the “required” vaccinations. It is TERRIFYING to think that you could potentially be denied work, daycare, or school. Unfortunately, we are not alone. We frequently receive messages about vaccine exemptions and this issue causes great distress for many families across Indiana.
To help alleviate that stress we have tried our best to make this process as simple as possible for you. All you need to do is: download the form relevant to your situation, complete it on a pdf editor or simply print and fill in by hand. By law you are not required to submit anything other than what is included in these forms unless indicated. We do want to be clear in stating that we are NOT a legal firm. We do not offer legal advice or representation.
 
What is on the form?
Each form will have a place for the date, your name or your child’s name, the requirements for the available exemptions, your signature, and the corresponding Indiana State code at the bottom for reference.

What should I expect when turning in an exemption for daycare/preschool, k-12, or higher education?
If you are filling out an exemption for a daycare, school, or higher education designation you can expect some push back. That is ok. Be polite, firm, and remind them they can review the Indiana state code, which is conveniently located on the form, or they can look it up themselves. Often, parents are asked to fill out a form that the school has, you are not LEGALLY obligated to do so. Some parents will complete it to remain in better graces with the school nurse, others simply decline. Some families like to email the exemption form to the school nurse or other responsible party, this allows for written acknowledgment of receipt upon response and can reduce discomfort for those who are nonconfrontational.
You will be required to complete and turn in a new exemption each year so don’t be surprised when this happens. Sometimes schools will send home a letter with threatening language similar to: “your child is missing some of the required vaccines. You have until *date* to complete the vaccinations or your child will not be allowed to attend school.” When this occurs, you need to turn in another religious exemption form for that year or remind the staff that you had submitted a religious exemption at the beginning of the year. Another common occurrence is the request for CHIRP authorization. While this doesn’t fall under the exemption, you have the right to revoke participation in the CHIRP system. What should I expect when completing a Healthcare Worker Influenza exemption?
As a nurse, I had no idea Indiana code providing exemptions for healthcare workers existed, and I am sure many of you will be amazed to learn this as well. Healthcare workers across the state have endured significant harassment and bullying over flu vaccines and we are excited to provide some education on this exemption.
There are a few stipulations you need to be aware of and we encourage everyone to exercise their rights in accordance with this code. You are ultimately responsible for the interactions with your employer. Again, we are NOT a legal firm. We do not offer legal advice or representation. Nothing in this section must be taken as legal advice, we encourage you to seek out legal counsel if you have any questions or concerns prior to turning in this exemption.
Indiana code 16-28-14.5 offers four (4) exemption options for the influenza vaccine to employees of a “comprehensive care facility” who “have direct contact with a patient or resident of the health facility.” According to IC 16-28-2.5-3 a “comprehensive care facility” is defined as “a health facility that provides, nursing care, room, food, laundry, administration of medications, special diets, treatments, and that may provide rehabilitative and restorative therapies under the order of an attending physician.” Essentially this covers most hospitals, long term care facilities, skilled nursing facilities and other inpatient rehab facilities. Below you will see the four options you have to choose from.
  1. The health facility:
    1. has written documentation from the employee's physician or other health care provider indicating the date and place that the individual received an immunization required under this chapter; and
    2. determines that no additional immunization is required;
  2. The immunization is medically contraindicated for the employee;
  3. Receiving the immunization is against the employee's religious beliefs; or
  4. The employee refuses to permit the immunization after being fully informed of the health risks.

We have heard countless stories of hospital employees who are being coerced into receiving a flu vaccine and know it is imperative to get this information out as soon as possible. We have had reports of health facilities administering “religion tests” for those submitting exemptions or denying an exemption entirely. I am sure if you are seeking this form for yourself you are already aware that you can anticipate some push back, but again, be firm yet polite and remind them that they can review the Indiana state code conveniently provided on the bottom of the form. If you are fearful of retribution or confrontation at the time of returning this form you may decide to email your exemption form through your work platform to Employee Health Services or to Human Resources. Keeping communication regarding your exemption through email provides you written documentation of the receipt and response to your exemption. It may be advisable to print out communications at the time they are received and save hard copies.
 
Patient Influenza/Pneumococcal vaccine exemption
This is another exemption I was unaware of even though I would often send patients to health care facilities that “require” influenza (flu) and pneumococcal (pneumonia) vaccines prior to admission. I don’t remember ever having a patient object; however, it was always presented as a prerequisite to being admitted. You may consider providing this exemption letter after you or your loved one has been accepted as a patient to the facility of your choice. It may be considered discrimination if a patient has previously been accepted to a facility prior to receiving an exemption form, and then is denied admission after. In many cases vaccinations are given on the day prior to discharge from a hospital and this may help you. Much like the healthcare worker exemption IC 16-28-14 offers four (4) exemption options as listed below.
  1. the health facility:
    1. has written documentation from the individual's physician or other health care provider indicating the date and place that the individual received an immunization required under this chapter; and
    2. determines that no additional immunization is required;
  2. the immunization is medically contraindicated as described in the product labeling approved by the United States Food and Drug Administration;
  3. receiving the immunization is against the individual's religious beliefs; or
  4. the individual refuses to permit the immunization as provided by state or federal law.
