If you have been injured by a COVID-19 vaccine, you may be eligible for compensation.

Countermeasure Injury Compensation Program

A countermeasure is a vaccination, medication, device, or other item recommended to diagnose, prevent or treat a declared pandemic, epidemic or security threat.

The Countermeasures Injury Compensation Program (CICP) covers injuries for vaccines that are not added to the childhood vaccine schedule. The following vaccines and medications fall under this program in the event of an injury:
  • COVID-19 (may include: remdesivir, baricitinib, monoclonal antibodies, ventilators, invasive testing, N-95, surgical masks, cloth masks, etc)
  • Marburg
  • Ebola
  • Nerve Agents and Certain Insecticides (Organophophorus and/or Carbamate)
  • Zika
  • Pandemic Influenza
  • Anthrax
  • Acute Radiation Syndrome
  • Botulinum Toxin
  • Smallpox

You have ONE YEAR from the date you were administered or used the covered countermeasure alleged to have caused the injury to request benefits.

If you have been injured by one of the above listed vaccines, please go to the HRSA website and follow the instructions to file a claim to request benefits.

You can file a claim for yourself or use an attorney, but this program does not reimburse for attorney fees. An injured countermeasure recipient may choose to use a legal or personal representative to assist in filing for medical and/or lost employment income benefits.

A representative may be:
  • A parent or guardian of a minor child
  • A spouse
  • A family member (e.g. sibling or adult child)
  • An attorney
  • Any other legal or personal representative capable of filing for benefits

If the injured countermeasure recipient is a minor, or does not have the legal capacity to file for Program benefits or receive payments, then a legal or personal representative must submit a Request Form on his or her behalf.

Please note: The CICP is not authorized to pay or reimburse any fees or costs incurred by using a legal or personal representative; therefore, you would be responsible for the cost of using one

Vaccine Injury Compensation Program

The Act of 1986 removed liability from the manufacturers of vaccines added to the childhood schedule and given to pregnant women. As a result the Vaccine Injury Compensation Program (V.I.C.P.) was created. 

This program is funded by an excise tax charged to each vaccine in the program.

In order to receive compensation you must file your petition within the following time frames:
  • Injury: within three years after the first symptom or manifestation of onset or of the significant aggravation of the injury;
  • Death: within two years of the death and within four years of the first symptom or manifestation of onset or of the significant aggravation of the injury from which the death resulted;
  • Certain Vaccine Injury Table (Table) changes: two years from the date of the Table change for injuries or deaths that occurred up to eight years before the Table change. A Table change includes new vaccines or injuries added to the Table or other changes to the Table if the revision makes a petitioner eligible to seek compensation or significantly increases the likelihood of a petitioner obtaining compensation. 
  • The Court may extend a deadline using equitable tolling in very limited circumstances.
 
Unlike the Countermeasures program, the VICP court generally will award reasonable attorneys' fees and other legal costs as long as your petition is deemed reasonable and filed in good faith. You may go to the VICP website for more information on filing a claim.

If at some point you decide that your story is too personal to share, let us know. We will not share your personal information and will only share with the "signature" you choose.
